Terms of Service

1. Acceptance of Terms

By accessing or using any service provided by NOVA APPS TEKNOLOJI LIMITED SIRKETI ("NOVA APPS", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Services

NOVA APPS provides custom mobile application development, web development, UI/UX design, and related digital product services. Specific deliverables, timelines, and terms for each project are defined in individual service agreements.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information required for project completion
• Respond to requests for feedback, approvals, and materials in a timely manner
• Ensure you have the legal right to use any content, trademarks, or materials you provide
• Make payments according to agreed schedules
• Not use our services for any unlawful purpose

4. Intellectual Property

Upon full payment, NOVA APPS assigns to you all intellectual property rights in the custom work developed specifically for your project. NOVA APPS retains rights to any pre-existing tools, frameworks, libraries, or methodologies used in development. We reserve the right to reference your project in our portfolio unless otherwise agreed in writing.

5. Influencer Collaboration Program

Participants in our Influencer Collaboration Program are subject to additional terms defined in a separate Collaboration Agreement. Key conditions include:

• Revenue sharing terms are defined per individual agreement
• Influencers agree to promote the product to their audience in good faith
• NOVA APPS retains ownership of the codebase; licensing terms are outlined in the agreement
• Either party may terminate the collaboration with 60 days written notice

6. Payment Terms

Payment schedules are defined in individual project agreements. Standard terms include a deposit prior to commencement and milestone-based payments. Late payments may result in project suspension. All fees are non-refundable unless otherwise specified.

7. Limitation of Liability

To the maximum extent permitted by law, NOVA APPS shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the total fees paid by you in the three months preceding the claim.

8. Confidentiality

Both parties agree to keep confidential all non-public information disclosed during the course of the engagement. This obligation survives termination of the agreement for a period of two years.

9. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of the jurisdiction where NOVA APPS is registered.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance. We will notify active clients of material changes via email.
